Privacy Policy
How your information is collected, used, and protected

Body Mōment operates from a clinic in Byron Shire and also provides mobile bodywork at client locations. Because the work involves health information, this policy applies in full — regardless of business size or turnover — under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
What's collected
Contact details — name, phone, email, and (for mobile sessions) the address where the session takes place.
Health information relevant to your treatment — injuries, conditions, medications, pregnancy, areas to avoid, and anything else that affects what's safe to do on the table or the mat.
Payment information — processed through third-party payment and booking providers; card details are never stored by Body Mōment directly.
Session notes — brief, professional notes kept to track your treatment history and preferences over time.
Photos or testimonials — only ever collected and used with your specific, separate consent (see below).
Why it's collected
To confirm and deliver your booking, to treat you safely and appropriately, to follow up on your care where relevant, and to meet basic legal and tax record-keeping obligations as an Australian sole trader.
How it's stored and protected
Health information is treated as sensitive information and is only accessed by Body Mōment — it is never sold, and it is not shared with marketers, insurers, or any other third party without your explicit consent, except where the law requires disclosure (for example, a genuine medical emergency, or a legal obligation such as a court order).
Right now, the practice's systems are:
Website — hosted on Google Sites.
Business email — Google Workspace.
Bookings, scheduling, and primary client records (identity and financial information) — Square.
Client session and treatment notes — a dedicated digital system for this is currently being developed. Until it's in place, these notes are kept as secure hard-copy records in a locked location.
If a fully digital system isn't practical at this stage of the business, records may instead be kept on an encrypted external hard drive, with a second backup drive stored at a separate secure location. Access is limited to the business owner, and to security staff only if the business ever engages any. This policy will be updated as the practice's systems evolve.
Google and Square are large international companies, and may store or process information on servers located outside Australia as part of their standard operations. Where this happens, it's governed by their own security and privacy commitments — set out in their respective privacy policies — and Body Mōment only works with providers that maintain strong data protection standards.
If something goes wrong
In the unlikely event your information is involved in a data breach, Body Mōment will act promptly to contain it and will notify you — and the Office of the Australian Information Commissioner, where required — under the Notifiable Data Breaches scheme.
Marketing, photos & testimonials
Your information is never used for marketing without your separate, explicit opt-in — for example, choosing to join a newsletter. The same applies to any before/after photos or testimonials: these are only ever used with your specific written consent, which you can withdraw at any time.
Cookies & the website
If the Body Mōment website uses cookies or analytics tools, this will be set out in a cookie notice on the site itself, and you'll be able to manage your preferences there.
Your rights
You can ask what information is held about you at any time.
You can ask for corrections if anything is inaccurate or out of date.
You can ask for your information to be deleted, subject to the minimum records required by Australian tax and business law (generally five years for financial records).
If you're ever unhappy with how your information has been handled, you're welcome to raise it directly — and you also have the right to contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
Retention
Health and session notes are kept for as long as you remain an active client, and for a reasonable period afterward in case you return. Financial records are kept for the period required by the Australian Taxation Office (currently five years).

Terms of Service
The terms that apply to every clinic and mobile session

These terms apply to all bodywork services provided by Body Mōment — whether at the clinic, at a mobile location, on the table, on the mat, or at a workshop. Booking means you've read and accepted them.
Scope of practice
Body Mōment's approach draws on holistic bodywork practices and theories — informed by evidence, and refined through peer-reviewed research and professional experience. This is not medical treatment, physiotherapy, chiropractic care, psychology, or medical diagnosis. No diagnosis, prescription, or medical advice is given. Where something outside this scope comes up, you may be referred to an appropriate health professional.
While every effort is made to provide safe, effective treatment, no guarantee is made about specific outcomes or recovery. Results vary from person to person.
Who this is for
Sessions are for adults (18+) unless a parent or guardian gives informed consent for a minor and remains present or immediately available for the duration. If a client brings other children along, they may be asked to wait outside the treatment space for everyone's comfort and privacy.
Health disclosure
You'll be asked to complete a short health intake before your first session, and to flag any changes at the start of every return visit. This is covered in full in the separate Informed Consent & Client Responsibilities document — please read it alongside these terms.
Table work and mat work
Table sessions use standard draping throughout, with only the area being worked on uncovered at any time. Mat-based bodywork is a different medium altogether — a more exploratory, creative approach that draws on and integrates a range of modalities, rather than following any single tradition. It's always performed fully clothed, and skin contact isn't a required part of the work. If you'd like to minimise skin contact for a particular technique, just say so at the start of the session so it can be tailored to you. Whichever modality you've booked, the approach is always led by consent, comfort, and clear communication.
Client conduct
Respect goes both ways. The following will not be tolerated and may result in a session being ended immediately, without refund:
Harassment, abuse, or discriminatory remarks
Sexual comments, requests, or behaviour of any kind
Aggressive or threatening behaviour
Filming or photographing a session without permission
Body Mōment also reserves the right to decline service — or decline future bookings — where a client arrives intoxicated, appears to be impaired by drugs, presents with an infectious illness, or has undisclosed health conditions that make treatment unsafe to proceed.
Medical emergencies
If the therapist reasonably believes a client needs emergency medical care during a session, Body Mōment may contact emergency services and/or a nominated emergency contact on your behalf.
Hygiene
Clients are asked to arrive reasonably clean, to disclose any contagious illness before booking or on arrival, and to reschedule rather than attend while unwell. This protects you, other clients, and the therapist.
If the therapist is unwell
Body Mōment may need to reschedule an appointment if the therapist becomes unwell. Where this happens, you'll be offered the next available time or a full refund.
Personal belongings
You'll often be relaxed, lying down, or not fully alert during a session, so it isn't realistic to expect you to keep watch over your own things. You're welcome to keep valuables within reach, or ask the therapist to set them aside safely at the start of the session. Beyond that reasonable care, Body Mōment isn't responsible for personal items left unattended at the clinic or a mobile location.
At the clinic
Parking is available nearby but isn't guaranteed — please allow time to find a spot.
Early arrivals may be asked to wait, as the space is generally in use for the session before yours.
Mobile sessions
For mobile bookings, you'll need to provide a clean, private, and safely accessible space, along with reasonable access for parking or loading. Table sessions need roughly 2m x 1m of clear floor space. Mat-based sessions need more room to move — around 2.5m x 2.5m — since the work often involves stretching and repositioning. A smaller space can sometimes work, but it will limit which techniques are available on the day. If the space isn't suitable or safe on arrival, the therapist may decline to proceed — this is treated as a no-show under the Booking & Cancellation Policy.
Circumstances outside our control
Body Mōment isn't liable where a service can't be delivered due to circumstances reasonably outside its control — for example, severe weather, flooding, power outages, or vehicle breakdown. Where this happens, you'll be offered a reschedule or refund.
Pricing
Prices may change from time to time without notice, but a confirmed booking keeps the price agreed at the time it was made.
Liability & insurance
Body Mōment holds professional indemnity and public liability insurance. While every care is taken to work safely within your disclosed health history, massage and bodywork carry an inherent low risk of soreness, bruising, or reaction — particularly if health information is incomplete. Clients take part in sessions on the understanding that they've disclosed relevant health information accurately.
Future bookings
Body Mōment reserves the right to decline future bookings from a client following a breach of these terms.
Governing law
These terms are governed by the laws of New South Wales. Commonwealth (federal) law also applies where relevant — including the Privacy Act 1988 and the Australian Consumer Law — regardless of anything else written here.

Booking & Cancellation Policy
How bookings, payments, and refunds work

Making a booking
Bookings can be made for the clinic or a mobile location, for table or mat-based work, and — as they become available — for workshops. A booking is confirmed once a time is agreed and, where requested, a deposit or full payment is received. You'll get confirmation details including the time, location, modality, and anything to prepare beforehand.
Payment
Payment is due at or before the time of the session unless other arrangements have been agreed in advance. Accepted payment methods will be confirmed at the time of booking.
Where a deposit is requested for a booking, this will be confirmed with you at the time of booking, and generally falls within the same notice windows as the cancellation policy below.
Pricing
Prices may change from time to time without notice, but a confirmed booking keeps the price agreed at the time it was made.
Cancellations & refunds
Life happens — plans change, and this policy is here to be fair to both you and the practice, which blocks out time (and, for mobile sessions, travel) to hold your slot.

Late arrival
If you're running late, let the therapist know as soon as possible. Sessions will generally run for the remaining booked time rather than extending past the next commitment, and full payment still applies.
Early arrival
At the clinic, early arrivals may be asked to wait briefly, as the space is generally in use until your appointment time.
Rescheduling & transfers
Rescheduling is treated the same as a cancellation for the purposes of this policy — the same notice windows apply. Where possible, moving a session to a new time within the same week is offered as an alternative to a refund. A booking can also be transferred to another person, provided you let Body Mōment know in advance.
Illness
If you're unwell — especially with anything contagious — please reschedule rather than attend. Sessions cancelled for genuine illness are treated with flexibility on a case-by-case basis, separate from the standard notice windows above.
Access on arrival (mobile sessions)
If the therapist arrives and the space isn't accessible or safe (for example, no one is home, or the space can't accommodate a treatment table or mat), this is treated as a no-show under the policy above.
Failed payments
If a payment fails, or is charged back without first getting in touch to resolve an issue, Body Mōment reserves the right to decline future bookings until the matter is sorted out.
Gift vouchers
Body Mōment will soon offer gift vouchers. Under the Australian Consumer Law, gift cards and vouchers sold for a monetary value must generally be valid for a minimum of three years from the date of purchase — businesses can't set a shorter expiry, and there are penalties for non-compliance. Issuing a gift voucher is, in effect, a commitment to honour it for up to three years. A small number of exemptions exist (for example, certain promotional or complimentary vouchers), but standard paid vouchers won't usually qualify. Voucher terms will be confirmed once this is finalised.
Packages
Packages — a bundle of pre-paid sessions for your own use — generally sit outside the gift card rules above, since they're a service arrangement with you directly rather than a voucher redeemable by anyone. A 6-month validity is the current plan, in line with the 180-day advance booking window. If packages are ever able to be gifted or transferred to someone else, this may bring the three-year gift card rule into play, so that detail will be confirmed before packages launch.
Workshops
Workshops involve fixed costs — venue, materials, and a place that could otherwise go to someone else — so they run on their own terms rather than the individual-session policy above:
Full payment is required to secure a place.
Cancelling more than 14 days before the workshop: full refund.
Cancelling within 14 days of the workshop: non-refundable, but your place can be transferred to someone else.
If Body Mōment needs to cancel or reschedule a workshop — for example, if it doesn't reach minimum numbers — you'll be offered a full refund or a place in the next one.
For larger corporate or private group bookings, these terms may be adjusted by agreement, with the above as the default starting point.

What to expect, and what we ask of you

Good bodywork depends on clear communication in both directions. This document explains what informed consent means at Body Mōment, and what's asked of you as a client so every session is safe and effective.
What informed consent means here
Before any treatment, you'll be talked through what the session will involve — the modality (table or mat), general approach, and anything specific to your situation. You're free to ask questions at any point, and treatment only proceeds once you're comfortable with what's planned.
Consent is ongoing, not a one-off box to tick. You can pause, adjust, or stop a session at any time, for any reason, without needing to explain why.
Your responsibilities
Disclose your health history accurately before your first session, including injuries, conditions, medications, pregnancy, and anything that might affect what's safe.
Flag any changes to your health at the start of every return visit — even small ones.
Speak up during the session if pressure, positioning, or technique needs adjusting.
Arrive reasonably clean, and reschedule rather than attend if you're unwell with anything contagious.
Let the therapist know about any discomfort, dizziness, or reaction during or after a session.
What to expect

Whatever the modality, the pace and depth of the session is guided by your comfort and feedback.
Special considerations
If you're pregnant, recovering from surgery, managing a chronic condition, or taking medication that affects circulation, sensation, or bruising, this needs to be disclosed before the session begins — it directly affects what's safe to do.
Minors
Clients under 18 need a parent or guardian to provide informed consent on their behalf, and that guardian needs to be present or immediately available for the full session.
Medical emergencies
If the therapist reasonably believes you need emergency medical care during a session, Body Mōment may contact emergency services and/or a nominated emergency contact on your behalf.
Not medical treatment
Body Mōment provides therapeutic massage and bodywork — not medical treatment, physiotherapy, chiropractic care, psychology, or diagnosis. If something comes up that's outside this scope, you may be referred to an appropriate health professional.
